Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the hyp platform (the "Service") operated by hyp ("us", "we", or "our").
1. Acceptance of Terms
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
2. Description of Service
hyp provides shared hosting and infrastructure-as-a-service (IaaS) for open-source applications. We operate multi-tenant clusters, provision compute, storage, networking resources, and automate deployments, updates, SSL certificates, and platform-level security patches. The Service is provided on a commercially reasonable, best-effort basis and may include maintenance windows, hardware refreshes, or migrations initiated by hyp.
3. Shared Hosting & IaaS Responsibilities
In our shared hosting model hyp is responsible for the underlying infrastructure, while you retain control over your application content and configuration. You agree that:
- hyp manages hypervisors, operating systems, container orchestration, load balancers, and data center providers.
- You are responsible for the code, themes, plugins, assets, and data that you upload to your instances, including compliance with all applicable laws.
- Support is limited to platform-level concerns. Custom code changes, debugging, or third-party integrations remain your responsibility.
- Because resources are shared, transient performance variations may occur. hyp may migrate workloads or throttle abusive processes to protect platform stability.
4. User Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
5. Acceptable Use
You agree not to use the Service to:
- Upload, post, host, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
- Harm minors in any way.
- Impersonate any person or entity.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
6. Payment and Subscriptions
Some parts of the Service are billed on a subscription or credit basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the plan you select when purchasing a Subscription.
Credits entitle you to run a limited number of applications concurrently. Credits that are unused at the end of a Billing Cycle expire and do not roll over unless stated otherwise. All payments are non-refundable unless otherwise stated in our Refund Policy.
7. Fair Use Policy
To protect the stability of our shared hosting and IaaS platform, you agree to comply with the following resource limits. hyp may monitor usage and take action (including throttling, temporary suspension, or plan upgrades) if your workload threatens platform stability or exceeds the limits of your plan.
- CPU: Burst CPU usage is permitted, but sustained utilization above the entitlement of your plan (typically 1 vCPU per Micro credit) may be throttled or migrated. Mining, distributed computing, or similar CPU-intensive tasks are prohibited.
- RAM: Each credit includes a defined RAM allotment. Consistently consuming more than the assigned memory may result in forced restarts or requests that you upgrade to a plan with higher limits.
- Storage: Storage quotas apply per app and across your account. You may not store backups of other systems, media libraries unrelated to the hosted app, or files that exceed reasonable growth for the selected plan. hyp may require you to remove excess data or purchase additional storage.
Fair use also prohibits using the platform as a general-purpose CDN, file distribution service, crypto miner, or any workload that materially degrades other customers' experience.
8. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
9. Limitation of Liability
In no event shall hyp, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
10. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
